NOTICE OF JOINT PUBLIC HEARING NOTICE IS HEREBY GIVEN, pursuant to General Municipal Law 704 that a petition by Douglas and Susan Ashby and the Village of Allegany for annexation to the Village of Allegany, New York (the “Village”), of certain territory contiguous to said Village has been received by the Town Board of the Town of Allegany, New York(the “Town”), and the Board of Trustees of the Village and a joint public hearing of the Town Board and Village Board has been scheduled for July 10, 2018 at 7:00PM, at the Town Hall, located at 52 West Main Street, Allegany, Cattaraugus County, New York, a joint hearing will be held by the aforesaid Town Board and Board of Trustees of the Village, upon said petition. The members of the aforesaid governing Boards of the Town and Village will meet at the time and place above-specified and will hear any objections which may be presented against such petition for annexation including but not limited to any of the following grounds: a) That a person signing the petition is not qualified therefore; or b) That the persons signing such petition do not constitute 20% of the persons residing within such territory qualified to vote for town officials; or c) That the persons signing such petition do not represent the owners of a majority in assessed value of the property within such territory assessed upon the last preceding town assessment roll; or d) That the petition does not otherwise specifically comply in form or content with the provisions of General Municipal Law Article 17 of the State of New York; or e) That the proposed annexation is or is not in the overall public interest: 1. Of the territory proposed to be annexed, or 2. Of the local government or governments to which the territory is proposed to be annexed, or 3. Of the remaining area of the local government of governments in which such territory is situated, or 4. Of any school district, fire district or other district corporation, public benefit corporation, fire protection district, fire alarm district or town or county improvement district situated wholly or partly in the territory proposed to be annexed. Objections, based upon subparagraphs a), b), c), or d) above must, in addition to oral testimony thereon, be in writing. The property that is the subject of the Petition is located solely in the Town, and is more particularly described as follows: ALL THAT TRACT OR PARCEL OF LAND, situate in the town of Allegany, County of Cattaraugus and State of New York, being part of Lot Seven, in Section One, Township Two and Range Five, of the Holland Land Company’s Survey, and bounded as follows: Commencing at a point in the center line of N. Seventh Street ten feet (10’) east from the west line of lands conveyed by Fred W. Fox and wife to Burritt A. Ensworth and Ellen V. Ensworth, his wife; running thence north on a line parallel to the west line of lands so conveyed by the said Fox to the said Burritt A. Ensworth and Ellen V. Ensworth, his wife, two hundred forty seven feet (247’); thence east one hundred feet (100’); thence south on a line parallel to the first mentioned boundary two hundred thirty nine feet (239’) to the center of Seventh Street; thence west along the center line of Seventh Street one hundred feet (100’) to the place of beginning. Also all that tract or parcel of land, situate in the Town of Allegany, County of Cattaraugus and State of New York and being a part of Lot Seven (7), in Section One (1), Town Two (2), Range Five (5) of the Holland Land Company’s Survey, bounded and described as follows: Commencing at a point in the center line of North Seventh Street, one hundred ten feet(110’) easterly from the west line of said lot and at the southeast corner of premises conveyed by Burritt A. Ensworth and wife to Donald Simpson; running thence north along the east line of Simpson’s lands, two hundred thirty nine feet, thence east five feet; thence south on a line parallel to the first mentioned boundary, about two hundred thirty nine feet to the center line of North Seventh Street; thence west along the center line of North Seventh Street, five feet to the point or place of beginning. NOTICE OF PUBLIC HEARING PROPOSED BUDGET VILLAGE OF ALLEGANY Notice is hereby given that the Board of Trustees of the Village of Allegany has prepared the annual budget for the upcoming year, June 1, 2018 to May 31, 2019. There is no tax increase in this budget. On Monday April 16, a public hearing will be held at 106 East Main Street, Allegany, NY at 5:50PM for the purpose of considering such budget. The itemized budget is on file in the office of the Village Clerk at 106 East Main Street, Allegany, NY where it may be seen by any interested persons during regular business hours.

NOTICE OF PUBLIC HEARING ZONING BOARD OF APPEALS VILLAGE OF ALLEGANY

Notice is hereby given that Michael John III has applied to the Village of Allegany Zoning Board of Appeals for an Area Variance for the property located at 101 North Fifth Street in an R-1, single- family residential district. He plans to construct a three car garage with a loft which will violate maximum height requirements. This application refers to Local Law #1-2008, Art. VII, Table 7.2, Table of Dimensional Regulations (A) regarding maximum height. The Zoning Board of Appeals will meet Wed. April 18, 2018 at 6:30 pm at the Village of Allegany Municipal Building, 106 East Main St., Allegany, NY to hear all interested persons. Information about the application may be obtained at the Village of Allegany Clerk’s Office during normal business hours.

NOTICE OF PUBLIC HEARING ZONING BOARD OF APPEALS VILLAGE OF ALLEGANY

Notice is hereby given that David and Tamara Hilmey have applied to the Village of Allegany Zoning Board of Appeals for an Area Variance for the property located at 20 North Seventh Street in an R-2, two- family residential district. They plan to replace their garage with a larger garage which will violate the maximum height requirements. This application refers to Local Law #1-2008, Art. VII, Table 7.2, Table of Dimensional Regulations (A) regarding maximum height. The Zoning Board of Appeals will meet Wed. April 18, 2018 at 6:30 pm at the Village of Allegany Municipal Building, 106 East Main St., Allegany, NY to hear all interested persons. Information about the application may be obtained at the Village of Allegany Clerk’s Office during normal business hours.
